Terms & conditions for Shell Repair USA
1. Acceptance of Terms
By engaging in the services provided by Shell Repair USA, you agree to be bound by these terms and conditions. If you do not agree to all the terms and conditions, please do not use our services.
2. Services Offered
(a) Shell Repair USA offers repair and maintenance services for rowing boats, racing canoes, coaching launches, and other composite structures.
(b) Estimates provided for repair services are based on an initial assessment and may be subject to change upon further inspection. We do not provide fixed quotes; instead, we track actual time and materials used on each job.
3. Time and Materials Tracking
(a) The customer will be billed based on the actual time spent and materials used during the repair process.
(b) An invoice will be provided upon completion that outlines the cost of the services performed and the total cost of the materials utilized.
4. Payment and Invoicing
(a) Payment is due upon completion of the repair services, based on the actual time and materials consumed, unless other arrangements have been made.
(b) Shell Repair USA reserves the right to retain possession of the repaired structure until full payment is received.
5. Storage Fees
(a) If the equipment has not been arranged to be picked up 30 days after the completion of services then storage fees will accrue.
(b) Storage fees are not prorated. Monthly fees are $50 per small boat, $100 per large boat, and $200 per catamaran.
6. Liability for Damages
(a) Shell Repair USA is not responsible for any pre-existing damages or issues with the structure that are not identified during the initial inspection.
(b) While every effort is made to ensure the quality of our repairs, Shell Repair USA is not liable for any damages or losses resulting from the use of the repaired structure.
7. Customer Responsibilities
(a) Customers are responsible for accurately describing the issues with their structure during the initial consultation.
(b) Customers are responsible for removing any personal items from the structure before submitting it for repair.
8. No Formal Warranty, but Commitment to Address Issues
(a) Shell Repair USA does not provide any formal warranty, express or implied, for the repair services performed.
(b) While no formal warranty is offered, Shell Repair USA is committed to addressing and rectifying any issues that may arise as a result of the repair services. We have stood by our work for over 40 years.
(c) Customers are encouraged to promptly report any concerns or problems with the repaired equipment to Shell Repair USA, and our team will make reasonable efforts to assess and, if necessary, rectify the issues.
9. Transportation Services
(a) Shell Repair USA offers transportation services for the convenience of customers wishing to have their equipment picked up or delivered.
(b) Unless otherwise specified, transportation fees will apply for the use of this service. The fee structure is as follows: $2.45 per expected mile the equipment will travel.
(c) Customers are responsible for clearly indicating their transportation needs during the initial consultation to ensure accurate billing.
(d) To utilize Shell Repair USA's transportation services, customers are required to maintain adequate insurance coverage for their equipment during transit.
(e) Shell Repair USA shall not be held liable for any damages to the equipment during transportation, and it is the customer's responsibility to seek compensation through their insurance provider in the event of any loss or damage.
10. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of New Jersey.
11. Changes to Terms
Shell Repair USA reserves the right to modify these terms at any time without notice. It is the customer's responsibility to review these terms periodically for changes.
